You have 30 days to file a registration application in Poland. The period runs from the day the vehicle was brought into Poland from another EU member state, from the day it was released for free circulation by the customs authority for an import from outside the EU, or from the day it was acquired in Poland. The penalty for missing it is fixed, not discretionary, and it attaches to the vehicle.

 

The part that costs foreign contractors money is not the length of the period. It is when it starts — and the fact that nothing you are waiting for stops it running.

Key facts

 

  • 30 days to file the application, under Article 73aa of the Road Traffic Act.
  • The period runs from one of three events: acquisition of the vehicle in Poland, its release for free circulation by the customs authority, or the vehicle being brought into Poland from another EU member state.
  • 90 days applies only to entrepreneurs whose business is trading in vehicles. A contractor, fleet operator or equipment owner does not qualify.
  • Penalty: PLN 500. If the application is still not filed 180 days after the deadline, a further PLN 1,000. For businesses in the vehicle trade the amounts are PLN 1,000 and PLN 2,000.
  • The obligation is the filing of the application, not the completion of the registration. What happens inside the office afterwards is not what the deadline measures.
  • Since 1 January 2024 the separate obligation to notify the authority of an acquisition has been replaced. Registration is the single act.

For a project fleet arriving from another member state, this means the clock starts at the border. Not when the documentation is complete. Not when the technical inspection is booked. Not when the approval procedure finishes.

The application must also state the date the vehicle was brought into Poland, evidenced by the importer's declaration or an annotation on the invoice — so the date is not something that stays vague in the file.

 

Who gets 90 days

 

Article 73aa provides a longer period, 90 days, for entrepreneurs carrying on business in Poland in the field of vehicle trading. It exists for dealers holding stock, not for companies that happen to own a lot of vehicles.

If you are not certain which period applies to you, assume 30 days. The cost of being wrong in that direction is nothing; the cost of being wrong in the other direction is a penalty per vehicle.

 

The penalties

 

The penalty for failing to file the application on time is PLN 500. If the application is still not filed 180 days after the deadline, a further PLN 1,000 applies. For entrepreneurs in the vehicle trade the corresponding amounts are PLN 1,000 and PLN 2,000. The penalty is imposed by the district authority by administrative decision.

Two things about it that matter more than the amount:

 

It is an obligation about a vehicle. Twelve vehicles that miss the deadline is not one problem with one penalty. The arithmetic on a mobilisation fleet is straightforward and unpleasant.

 

It is separate from everything else. An approval procedure that is running correctly, a technical supervision decision that is properly in progress, a manufacturer that has promised the missing documentation — none of these is a defence, because none of them is what the deadline measures.

Why this is a fleet problem, not a vehicle problem

 

For a single imported car, 30 days is generous. For a project fleet it is the tightest constraint in the whole mobilisation, and it is tight for a structural reason: the deadline runs on arrival, but almost everything that has to happen before you can file takes place before or after arrival, not during it.

 

Consider what a typical file needs before an application can be lodged: an approval document covering the vehicle in its delivered state, a technical inspection certificate, sworn translations of foreign documents, and — where the vehicle carries equipment subject to technical supervision — a decision from the technical supervision authority, without which the technical inspection cannot be carried out at all.

None of those are fast if they start when the vehicles arrive. All of them can be finished before arrival if they start when the vehicles are ordered.

 

What we see in practice

 

The pattern is consistent. A fleet is shipped as soon as the project schedule allows, because the site needs the equipment. The documentation gap is discovered on arrival, when someone takes the file to the office for the first time. An approval procedure begins. It is conducted properly and it takes as long as it takes. Meanwhile the 30-day period expires on every vehicle simultaneously, because they all arrived on the same convoy.

The teams that avoid this do one thing differently: they treat the arrival date as a deadline they set themselves, and work backwards from it, rather than as the day the process begins.

 

What does not stop the clock

 

  • An approval procedure in progress before the Director of TDT.
  • Waiting for a technical supervision decision on mounted equipment.
  • Waiting for the manufacturer to issue or reissue a Certificate of Conformity.
  • Translations in progress.
  • The vehicle being physically unusable, unfinished or in a workshop.
  • The registration office asking for further documents.

 

None of these suspend the period. This is not a Polish peculiarity — it follows from the deadline being attached to a physical event, arrival, rather than to a state of readiness.

 

If the deadline has already passed

 

It is not a reason to slow down. The second penalty threshold sits at 180 days after the deadline, so the exposure grows in steps rather than continuously, and filing as soon as the file is complete limits it.

Practically, the sequence is: establish what is actually missing, decide the shortest route to a filable application, and document why the delay occurred. Whether the reason for the delay carries any weight is a matter for the authority, and it is not something to rely on. Does an approval procedure stop the deadline? No. A procedure before the Director of TDT, a pending technical supervision decision or a manufacturer who has not yet issued the missing document do not suspend the period. They run in parallel with it.

The delay is the manufacturer's fault. Does that help? Not automatically. The obligation sits with the vehicle's owner, and the deadline measures the filing of an application, not the availability of documents. Documenting the cause of the delay is worth doing, but it should not be treated as a substitute for filing as soon as the file allows.

Can we avoid this by keeping the vehicles on foreign plates? That is a different question with a different answer, and it depends on how and for how long the vehicles are used in Poland. It should be settled before shipping rather than assumed.
